One of the Commission's functions under the Essential Services Commission Act 2002, (the "ESC Act") is to regulate prices under relevant industry regulation Acts. TheĀ Gas Act 1997 is a relevant industry regulation Act which assigns a function to the Commission in addition to its functions and powers under the ESC Act. It expressly provides the Commission with the power to undertake price regulation functions in accordance with its terms. The Commission currently regulates gas retail and market administrator prices.
From 1 July 2008, with the commencement of a new National Gas Law, the economic regulation functions of South Australia gas distribution network were transferred to theĀ Australian Energy Regulator. Prior to that date the Commission was responsible for economic regulation of the gas distribution network in South Australia.
